Affiliate Terms of Service

1. Agreement

By applying to and participating in The Miccoli Group Affiliate Program ("Program"), you ("Affiliate") agree to be bound by these Terms of Service. The Program is operated by The Miccoli Group ("Company," "we," "us").

2. Eligibility

You must be at least 18 years of age and have a valid email address to participate. Applications are reviewed and approved at our sole discretion. We reserve the right to decline any application without explanation.

3. Approved Marketing Materials

Affiliates may only use:

• Their unique assigned referral link
• Images and banners provided in their affiliate dashboard

Affiliates may not:

• Create their own representations, graphics, or descriptions of our brands or products
• Modify or alter our approved images in any way
• Use our brand names, logos, or trademarks in domain names or business names
• Make any claims about our products or services beyond what is stated in approved materials

4. Prohibited Conduct

The following are strictly prohibited and will result in immediate termination and forfeiture of unpaid commissions:

• Spam emails, unsolicited messages, or comment spam
• False, misleading, or exaggerated claims about our products or services
• Self-referral — purchasing through your own link or directing friends/family to do so fraudulently
• Cookie stuffing or any other fraudulent click or tracking manipulation
• Bidding on our branded keywords in paid search without prior written approval
• Any conduct that violates applicable laws or regulations

5. Commissions

Affiliates earn a 10% commission on the net sale amount of confirmed purchases made by referred customers. Commissions are tracked via your unique referral link and/or discount code. Commissions are held for 45 days after the sale date to allow for chargebacks, refunds, and dispute resolution. Commissions on reversed or refunded transactions are void. We reserve the right to adjust commission rates with 30 days notice.

6. Payments

Payouts are processed on the 1st and 15th of each month for cleared balances over $25.00 CAD. Payment is made via Stripe, Square, or Canadian e-transfer to the payment email on file in your dashboard. You are responsible for any taxes on earnings in your jurisdiction.

7. Paid Advertising

Affiliates are permitted to run paid advertisements using approved images and their referral link, provided the ads comply with all platform policies and these Terms. Any paid advertising must clearly disclose the affiliate relationship as required by applicable laws (e.g., FTC guidelines in the US, ASA guidelines in the UK).

8. Disclosure

You must clearly disclose your affiliate relationship when promoting our products. This includes using disclosures such as "#ad," "#affiliate," or "I earn a commission from this link" in any public-facing content.

9. Termination

We may terminate your participation in the Program at any time, with or without cause, with or without notice. Upon termination, any earned and cleared commissions will be paid out at the next scheduled payout date. Commissions still within the 45-day hold period may be forfeited if termination is due to a violation of these Terms.

10. Modifications

We reserve the right to modify these Terms at any time. Continued participation in the Program after changes are posted constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the Province of British Columbia, Canada, without regard to conflict of law principles.
